1. Agreement to Terms

By accessing or using Hungry Machines ("the Service"), operated by Encephalon Labs ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Account Terms

• You must provide a valid email address and accurate information to create an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to use the Service.
• One person or entity may not maintain more than one free account.

3. The Service

Hungry Machines provides energy optimization schedules for home appliances including HVAC systems, EV chargers, home batteries, and water heaters. The Service generates recommendations based on time-of-use electricity pricing, your comfort preferences, and sensor data from your home.

Schedules are recommendations, not guarantees. Actual energy savings depend on your utility rates, equipment, home characteristics, weather conditions, and how closely the generated schedules are followed.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to other users' accounts or data.
• Interfere with or disrupt the Service or its infrastructure.
• Submit false, misleading, or artificially generated sensor data.
• Reverse-engineer, decompile, or disassemble any part of the Service beyond what applicable law permits.
• Resell or redistribute the Service without written permission.
• Exceed documented API rate limits or abuse the Service's resources.

5. Paid Subscriptions

Some features require a paid subscription ("Premium"). Payments are processed through Stripe. By subscribing, you agree to pay the applicable fees for your chosen plan.

• Subscriptions renew automatically unless canceled before the end of the current billing period.
• You can manage or cancel your subscription through the Stripe Customer Portal accessible from your dashboard.
• Refunds are handled on a case-by-case basis. Contact us at info@hungrymachines.io for refund requests.
• We reserve the right to change pricing with 30 days' advance notice.

6. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.

7. Intellectual Property

The Service, including its optimization algorithms, interface, documentation, and branding, is owned by Encephalon Labs and protected by applicable intellectual property laws. Your data remains yours — we claim no ownership of the sensor readings, preferences, or other information you submit.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that optimization schedules will achieve any specific level of energy savings.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Encephalon Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with reasonable notice where practicable. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive (such as limitation of liability) will remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration in accordance with applicable rules.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
